Writing A Will
Who needs to write a Will?
Without a valid Last Will and Testament any assets you leave on death will be distributed according to the Rules of Intestacy. These rules lay down a rigid method of estate distribution and make no account of your wishes, unless you write a will.
Wills For Married & Unmarried Couples
For married couples, without a Will it is not certain that your spouse will inherit all your assets. Under Intestacy spouses only automatically inherit £250k of their partners estate plus 50% of the remainder with the balance going to direct descendants.
Over past years there have even been cases of mother’s having to sue their own children to gain access to money which has been passed on to due to no Will being in place.
If you are an unmarried couple and you do not write a Will your partner may not receive anything. Rules of Intestacy make no provision for unmarried partners. So if you live together without being married it is vital that you both have Wills if you wish to make sure your partner inherits from your estate.
